Samsung files emergency stay in damages trial as USPTO invalidates Apple patent

Today in a Northern California District Court, Samsung filed an emergency motion to halt proceedings in the damages phase of its patent infringement case with Apple. This request follows a USPTO advisory action that calls into question the validity of Apple’s pinch-to-zoom patent.

The USPTO decision affects the ’915 patent which covers Apple’s pinch-to-zoom technology. It describes a process by which a device can determine whether a user is scrolling with one finger versus using several touch points at the same time as would be recorded in a pinch-to-zoom action.

Samsung argues that this USPTO decision has an immediate impact on these post trial proceedings. Samsung writes in its motion,

“This decision by the PTO jeopardizes the jury’s findings in the damages trial and may render all of the post-trial proceedings a waste of time and resources.”

Judge Lucy Koh has said she will consider this stay tomorrow after Apple has had a chance to respond.
